Question: A young Shee`ah attending one of the universities in the United States died and some of the Muslims were wondering if they could attend the janaazah (funeral prayer) of the Shee'ah and ask forgiveness for him? Please advise.

Answer: This returns to the man's way of life whilst alive. If his way of life was in conformity with the statement of the Prophet صلى الله عليه وسلم when he mentioned the Nations saying: "The Jews split into seventy-one (71) sects, and the Christians split into seventy-two (72) sects, and this Ummah would split into seventy-three (73) sects, all of them in the fire except one." They said "Who are they O Messenger of Allaah?" He صلى الله عليه وسلم replied "Those who are upon what I and my Companions are upon today."[1] So, if his life was in conformity with the Saved Sect then there is no objection with praying over him (janaazah) or burying him in the Muslim cemetery. If however, he did not meet this criteria i.e. he was upon that which mandated disbelief, then it is not permissible to pray over him or attend his janaazah.

The first part of the hadeeth, with the following wording, Shaykh al-Albaanee رحمه الله says Saheeh in Saheeh al-Jaami', Hadeeth (#1083).
افترقت اليهود على إحدى وسبعين فرقة وتفرقت النصارى على اثنتين وسبعين فرقة وتفرقت أمتي على ثلاث وسبعين فرقة

The latter part of the hadeeth found with the following wording as part of a longer hadeeth. Shaykh al-Albaanee رحمه الله says Hasan in Jaami' at-Tirmidhee, 5/26 Hadeeth (#2641).
كلهم في النار إلا ملة واحدة قالوا ومن هي يا رسول الله قال ما أنا عليه وأصحابي

Answer: Yes, it is in accordance with what is necessary.

Question: A person was killed, so the doctors removed the brain from the body for medical tests. So what is better: to bury the body immediately without the brain or to wait a period of up to six weeks, until the tests are complete and the brain is returned to the body and then to bury the body? And if the person is buried without the brain, what is then the correct way to bury the brain separately?

Answer: If the doctors mention that the person is dead and his heart has stopped and there is no life in him, then the body should be buried and it should not be waited on because the sunnah is that the body should be buried. As soon as they get through with the brain of the deceased, then that should also be buried.

Question: The next question is about exhumation i.e. to get the dead body and to conduct tests for establishing the cause of death or crime or DNA identification. Is it permissible in Islaam, if yes, under what circumstances, and can it be done by a female expert?

Answer: The Shaykh hafidhahullaah, he said this question concerning the autopsy of the person, inshaa Allaah we can leave it until a later time because the kibaar 'ulemaa over there are studying the subject at this point and maybe with our next meeting we can have our answer inshaa Allaah.
